Distance Sales Agreement
This Distance Sales Agreement ("Agreement") is concluded between Turgame.com ("Seller") and the consumer ("Buyer") who places an order via the website. It governs the sale and electronic delivery of digital gift cards, game pins, and related codes.
For Turkish residents, this Agreement is issued in compliance with Consumer Protection Law No. 6502 and the Distance Contracts Regulation. For customers in other jurisdictions, equivalent consumer-protection rules of the EU Consumer Rights Directive and applicable local law apply.
1. Parties
Seller: Turgame.com — Istanbul, Türkiye — [email protected]
Buyer: the natural or legal person who confirms this Agreement by placing an order.
2. Subject Matter
The subject of this Agreement is the electronic sale and instant delivery of the digital products listed in the order summary, with the prices and quantities shown on the checkout screen.
3. Product, Price, Taxes
The basic characteristics of each product, brand, region, total price (VAT included), payment-method fees, and applicable currency are presented to the Buyer before confirming the order. Final amounts shown on the checkout screen are binding.
4. Payment
All payments are processed through PCI-DSS-compliant payment service providers (Stripe, iyzico, PayPal, Binance Pay). 3D Secure is applied where supported by the issuing bank. The Seller does not store full card numbers — only the last four digits are retained for receipts and dispute handling.
5. Delivery
- Digital products are delivered electronically immediately after payment is captured.
- Delivery occurs (a) on the order detail page inside the Buyer's account, and (b) by email to the address the Buyer provided.
- Before the pin code is revealed on screen, the Buyer is shown a code-reveal acknowledgment and must accept it. The acknowledgment is recorded with timestamp, IP, user-agent, device fingerprint, and version hash for forensic evidence.
6. Right of Withdrawal
Important — Digital codes that have been revealed cannot be returned. Article 15/1-(ğ) of the Turkish Distance Contracts Regulation and Article 16(m) of the EU Consumer Rights Directive both exclude digital content delivered immediately from the standard 14-day withdrawal right once performance has begun.
If the Buyer has NOT yet viewed the pin code, the order may be cancelled and refunded within 14 days of purchase. Detailed steps are described in the Refund Policy.
7. Liability
The Seller warrants that the delivered codes are genuine and originate from authorised sources at the time of sale. The Seller is liable for codes that are invalid through fault of the Seller's supply chain. The Seller is not liable for codes used or shared by the Buyer, or for region/platform restrictions that the Buyer was informed of before purchase.
8. Force Majeure
Neither party is liable for failure to perform caused by events beyond reasonable control, including PSP outages, platform-side blocks, sanctions, natural disasters, or strikes affecting the Seller's infrastructure or suppliers.
9. Dispute Resolution
For Turkish consumers, the Provincial / District Consumer Arbitration Committees ("Tüketici Hakem Heyetleri") and Consumer Courts have jurisdiction up to the statutory thresholds. EU consumers may use the European Online Dispute Resolution platform (ec.europa.eu/consumers/odr). The Seller is also reachable directly at [email protected].
10. Entry Into Force
This Agreement enters into force the moment the Buyer confirms the order on the checkout page. A copy is stored permanently in the Buyer's order history and may be requested by email at any time.
